It is understood that RestoreMax is strictly a distributor and service provider of certain products or materials used or sold under the terms of this Agreement in conjunction with its services. Other than the warranties extended directly by the manufacturers of the materials or specifically stated by RestoreMax in this agreement, it is understood that there are no express or implied warranties made by the RestoreMax as to any products or materials sold or incorporated into the OWNER/AGENT’s premises hereunder. RestoreMax makes no warranty, express or implied, as to the fitness for use or condition of the systems or components provided, installed, inspected or repaired by any third party. RestoreMax warrants that all work will be performed in a workmanlike manner and will be free of defects for a period of six (6) months from the date of completion (the "claims period"). All claims of any nature resulting from this agreement must be made in writing, addressed to the RestoreMax and sent by registered or certified mail to RestoreMax within the claims period. Claims made for defects in materials must be presented to the manufacturer of the materials. Hidden defects and previously existing conditions are excluded from RestoreMax’s warranty. Peeling paint (other than paint applied by the RestoreMax) is excluded. Notwithstanding the foregoing, any warranties shall be limited to any work actually performed by RestoreMax and in no event shall RestoreMax be liable for consequential damages or damages caused by termite or other wood destroying organisms or fire, tornado, hail, hurricane, settlement, vandalism, acts of God or other condition outside the reasonable control of RestoreMax. The warranty period begins with completion of each part of the work and is not contingent on final inspection and is not transferrable to other parties. OWNER/AGENT’s failure to pay for completed work will void the warranties.
Designer’s Choice Cabinet Limited Warranty
Designer’s Choice warrants to the original user that your cabinets will be free from defects in material and workmanship under normal and proper use for a period of five years from date of purchase. Any part which proves defective under normal use will be replaced by Designer’s Choice. This warranty does not include labor, installation or transportation costs. Nor does it include damages from improper handling or installation. At Designer’s Choice Cabinetry only select grade & better, oak, maple, and cherry is used in the production of wood doors and moldings. Notably oak has a range in color of white, yellow, and pink and sometimes is streaked with green and black mineral deposits. Hard maple is predominantly off-white in color, but may contain colors like yellow-brown and pink. Additionally, every wood species exhibits other characteristics including knots, pinholes, sap runs, and darkening with age. It is important to note that no two doors will be alike, and although Designer’s Choice stain and glaze using the latest techniques, color variations will not be considered a defect and will not be replaced under warranty.
